This Privacy Policy explains how we collect, use, disclose, and otherwise process personal information in connection with our services. This Privacy Policy is not, however, a contract and does not create any legal rights or obligations.  

Who We Are: Viridis Technologies is a web development company incorporated in Wyoming. When we use the terms “Viridis Technologies”, “we”, “us” or “our” in this Privacy Policy, we are referring to Viridis Technologies Corp and any other of our affiliates. 

Our Services: When we use the term “services”, we are referring to all the services that we offer on our own behalf, including without limitation, our product and service offerings and the websites and services that post or link to this Privacy Policy now or in the future. 

This Privacy Policy does not cover or address, for example: 

  • Job Applicants and Viridis Technologies Personnel – Personal information and privacy practices relating to job applicants, employees and other personnel; 
  • Third Party Viridis Technologies Product Sellers – Privacy practices of independent third-party retailers that sell our products and that are not Viridis Technologies-branded franchise stores. 

By accessing or using the services, you signify that you have read, understood and agree to our collection, storage, use and disclosure of your personal information as described in this Privacy Policy and our Terms of Use. 

Region-Specific Disclosures 

We may choose or be required by law to provide different or additional disclosures relating to the processing of personal information about residents of certain countries, regions or states. Please refer below for disclosures that may be applicable to you:      

  • If you are a resident of the State of Nevada in the United States, please see below for Nevada-specific privacy disclosures. 

Chapter 603A of the Nevada Revised Statutes permits a Nevada resident to opt out of future sales of certain covered information that a website operator has collected or will collect about the resident. We do not sell your covered information, as defined by Chapter 603A of the Nevada Revised Statutes. If you reside in Nevada, you have the right to submit a request to support@viridistech.us to opt out of the sale of covered information. Please include “Nevada Rights Request” in the subject line. 

  What is Personal Information?     

When we use the term “personal information” in this Privacy Policy, we mean information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, to you. It does not include aggregated or deidentified information that is maintained in a form that is not reasonably capable of being associated with or linked to you. 

  Our Collection of Personal Information   

From the first moment you interact with us, we are collecting personal information about you. Sometimes we collect personal information automatically when you interact with our services and, sometimes, we collect the personal information directly from you. At times, we may collect personal information about you from other sources and third parties, even before our first direct interaction. We may link or combine your activities and information collected from you on our websites with information we have collected from you offline (e.g., in-store), information we receive from third parties, as well as information we collect automatically through tracking technologies (defined below). This allows us to provide you with a personalized experience regardless of how you interact with us.  

Personal Information You Provide 

We collect the following personal information you provide in connection with our services: 

  • Contact and Profile Information.   We collect personal information, such as your name, email address, password, telephone number, gender, zip code, and address when you create an account, sign up for a newsletter, request a transaction or make a purchase online or in-store, consent to receive text message, redeem or participate in a promotion, purchase or redeem a gift card or otherwise communicate with us. We collect any communications between you and us and any other information you provide to us. We also collect information about your use of our services, such as your orders, and similar activity.    
  • Payment and Transaction Information.  We may collect information such as items purchased, date and time of your transaction, amount purchased, order details, whether you used a particular coupon or deal, and payment information, such as your credit/debit card or gift card details, when you make an in-store or online purchase. 
  • Shopping History. For example, we may collect personal information about the items you viewed on our website, added to your cart, purchased or returned.  

We use this information to operate, maintain, and provide to you the features and functionality of the services, as well as to communicate directly with you, such as to send you email messages.  We may also send you service-related emails or messages (e.g., user account verification, change or updates to features of the services, technical and security notices) and communications from or about Viridis Technologies. 

Personal Information Automatically Collected When You Use our Services 

Like most digital platforms, we collect certain personal information automatically when you visit our online services, including: 

  • Information About Your Device and Its Software. This may include your IP address, browser type, Internet service provider, device type/model/manufacturer, operating system, date and time stamp, and a unique ID that allows us to identify your browser or your account (including, for example, a persistent device identifier or an Ad ID), and other similar information. We may also work with third-party partners to employ technologies, including the application of statistical modeling tools, that permit us to recognize and contact you across multiple devices.   
  • Information You May Post or Submit to Our Website.  We may collect information about how you use and interact with our websites and services, including any content you post to the services.  
  • Information About The Way You Access And Use Our Services. This may include, for example, the site from which you came and the site to which you are going when you leave our services, the pages you visit, the links you click, whether you open emails or click the links contained in emails, whether you access the services from multiple devices, and other actions you take on the services.  
  • Analytics Data. This may include the electronic path you take to our services, through our services and when exiting our services, as well as your usage and activity on our services, such as the links and objects you view, click or otherwise interact with (also known as “Clickstream Data”). We may collect analytics data or use third-party analytics tools such as Adobe Analytics and Google Analytics to help us measure traffic and usage trends for the services and to understand more about the demographics of our users.   • Location Information. We collect information about your location for the purpose of providing our services. We may collect location through WiFi, wireless network triangulation and other methods or we may also approximate your location by your IP Address.  

Personal Information Collected In-Store 

  • Payment and Transaction Information. We may collect information about your in-store transaction such as items purchased, items of interest, date and time of your transaction, amount purchased, and payment information, such as your credit/debit card or gift card details, when you make an in-store purchase.

Personal Information from Other Sources and Third Parties 

We also obtain personal information from other sources, which we often combine with personal information we collect either automatically or directly from you.  

We receive the same categories of personal information as described above from the following sources and third parties: 

  • Information We Receive from Third-Party Sites You Connect to Our Services.  Some parts of our services may allow you to login through a third party social network or authentication service such as Facebook. These services will authenticate your identity and provide you the option to share certain personal information with us, which could include your name, email address, address book and contacts, or other information. The data we receive is dependent on that third party’s policies and your privacy settings on that third-party site.  
  • Social Networks Through Your Interactions.  When you interact with our services through various social media networks, such as when you “Like” us on Facebook or when you follow us or share our content on Facebook, Twitter, Snapchat, LinkedIn, Instagram or other social networks, we may receive some information about you that you permit the social network to share with third parties. The data we receive is dependent upon your privacy settings with the social network. You should always review and, if necessary, adjust your privacy settings on third party websites and social media networks and services before linking or connecting them to our services.  
  • Information Provided by Others.  From time to time, we may receive information about you from third parties and other users. For example, we may obtain information from our marketing partners or from third parties to enhance or supplement our existing user information. We may also collect information about you that is publicly available. We may combine this information with the information we collect from you directly. 
  • Information Provided by Viridis Technologies Entities. We may receive information about you from other Viridis Technologies companies and affiliates, so that information you provide may be used by Viridis Technologies to provide you services, communicate with you or provide you advertisements or other personalized content.  
  • Information Provided by Franchisees.  We may receive information about you from franchisees that operate Viridis Technologies-branded stores. 

  Our Use of Personal Information         

We and the third parties we work with may use personal information:  

  • To process your registration on our services, including verifying your information to ensure its accuracy and validity. 
  • To fulfill your requests (e.g., to allow you to place an order in-store or online, have it delivered to you, or to provide you with information that you request). 
  • To fulfill your purchases (e.g., to process credit card payments in connection with your transaction). For example, we use this information to provide the services to you across our operations, including by supporting your in-store experience when you engage with our Viridis Technologies-owned & operated and franchisee-owned locations. 
  • To personalize your experience (e.g., to locate the Viridis Technologies stores closest to your location) and customize content on our services relevant to your interests, including but not limited to targeted offers and ads through our website, email, social media channels, third-party sites, or on other devices you may use. 
  • To operate, maintain, and provide to you the features and functionality of the products and services. 
  • To send you important information regarding the services, such as certain changes to our terms, conditions, policies, and/or other administrative information. Because this information may be material to your use of the services, you may not opt out of receiving such communications. 
  • To inform you of products, programs, services, and promotions that we believe may be of interest to you, including, without limitation, adding you to our email/mailing lists and permitting you to participate in sweepstakes, contests, and similar promotions (collectively, “Promotions”). 
  • To present advertising online and via emails, text messages, or other communication channels, including through social media platforms and internet search engines. 
  • To evaluate your eligibility for certain types of Promotions, offers, products, or services that may be of interest to you. 
  • To help maintain the safety, security, and integrity of our service, technology assets, and business. 
  • For our internal business purposes, such as data analysis, customer research, audits, fraud prevention, developing new products and/or features, enhancing the services, improving our services, identifying usage trends, and determining the effectiveness of our promotional campaigns, including to inform our machine learning for purposes such as user engagement. 
  • To respond to law enforcement requests and as required by applicable law, court order, or governmental regulations and enforce our corporate reporting obligations and our Terms of Use, or to comply with applicable laws. 
  • For purposes disclosed at the time you provide your personal information or as otherwise set forth in this Privacy Policy. 

We may also use aggregate personal information in a manner such that the end-product does not uniquely identify you or any other user of the services.  

If you choose to contact us, we may need additional information to fulfill your request or respond to your inquiry. We may provide additional privacy disclosures where the scope of the inquiry/request and/or personal information we require fall outside the scope of this Privacy Policy. In that case, the additional privacy disclosures will govern how we may process the information you provide at that time.  

  Our Disclosure of Personal Information         

We disclose personal information in the following ways:  

  • Within Viridis Technologies: We share personal information with our parent company, subsidiaries, owned and operated stores and affiliates, so that they also may use such Personal information for the purposes described in this Privacy Policy. Viridis Technologies entities disclose personal information to other Viridis Technologies entities for purposes and uses that are consistent with this Privacy Policy.   For example, we may disclose your contact information to process and fulfill your order or to facilitate communication between you and a local Viridis Technologies representative. 
  • Our Franchisees:  We may share your personal information with our franchisees, particularly when we collaborate in providing the services to you. For example, we may share certain personal information so that our franchisees can view your account and purchase history in-store to better serve you.  We may also need to share certain personal information with a franchisee in order to provide return or refund information that you may request through the services. We also may share information with our franchisees in order to provide local offers and promotions that might interest you.  
  • Promotional Partners: We may share limited information with third parties with whom we partner to provide contests and sweepstakes, or other joint promotional activities. These partners will usually be clearly identified in the contest rules or promotional materials. 
  • Third Parties at Your Request:  You may choose to share your activities on the services with your friends through email or on various social media networks. 
  • Online Advertising Partners.  We also share personal information with advertising networks or permit these partners to collect information from you directly on our websites to facilitate online advertising, such as search engines and social network advertising providers to serve targeted ads to you or to groups of other users who share similar traits, such as likely commercial interests and demographics, on third-party platforms.   • The Public:  When you provide feedback or post user content on our services (e.g., if you post a product review on our website or comment on our social media sites), your information (e.g., your first name and comments) may be displayed on our websites or on our social media pages. When you engage with us on social media, we may tag your social media account or the social media account of others (e.g., to give photo credit to another user).  
  • Service Providers. We share personal information with third-party vendors, consultants and other service providers who perform functions or services on our behalf and under our instructions to make our services available to you. For example, this may include vendors and providers who engage in marketing or advertising activities or provide mailing or email services, tax and accounting services, auditing and compliance, fraud prevention, infrastructure provisioning, analytics services, IT services, product fulfillment, and web hosting. 
  • Business Transaction or Reorganization: We may take part in or be involved with a corporate business transaction, such as a merger, acquisition, joint venture, or financing or sale of company assets. We may disclose personal information to a third-party during negotiation of, in connection with or as an asset in such a corporate business transaction. Personal information may also be disclosed in the event of insolvency, bankruptcy, or receivership. 
  • Legal Obligations and Rights:  We may disclose personal information to third parties, such as legal advisors and law enforcement:  
  • in connection with the establishment, exercise, or defense of legal claims;  
  • to comply with laws or to respond to lawful requests and legal process;  
  • to protect the rights and property of Viridis Technologies, our agents, customers, and others, including to enforce our agreements, policies, and terms of use; 
  • to detect, suppress, or prevent fraud;  
  • to reduce credit risk and collect debts owed to us;  
  • to protect the health and safety of us, our customers, or any person; or  
  • as otherwise required by applicable law. 
  • With Your Consent or At Your Direction:  In addition to the sharing described in this Privacy Policy, we may share information about you with third parties whenever you consent to or direct such sharing. 

We may also share personal information which has been aggregated or de-identified in a manner such that the end-product does not uniquely identify you. 

Choices and Control Over Your Information 

Profile and settings:  You may update your account information and adjust your account settings by logging into your account. Please note that changes to your settings may require some time to take effect.  

How to control your email preferences: You can stop receiving promotional email communications from us by clicking on the “unsubscribe link” provided in such communications. We make every effort to promptly process all unsubscribe requests. You may not opt out of service-related communications (e.g., account verification, transactional communications, changes/updates to features of the Service, technical and security notices). You may also be able to adjust certain communications preferences by logging into your account.  

Online advertising and tracking.  Please see Cookie Policy to learn more about how we work with third party partners to collect data through tracking technologies for various purposes, including analytics and advertising, and to understand your choices.  

Text Messaging: We will not send you any marketing text messages unless you consent to receive them. To stop receiving text messages, follow the opt out instructions contained in the text message.  

Children’s Personal Information 

Our websites and online services are not directed to, and we do not intend to, or knowingly, collect or solicit personal information from children under the age of 13. If you are under the age of 13, please do not use our websites or online services or otherwise provide us with any personal information either directly or by other means. If a child under the age of 13 has provided personal information to us, we encourage the child’s parent or guardian to contact us to request that we remove the personal information from our systems. If we learn that any personal information we collect has been provided by a child under the age of 13, we will promptly delete that personal information. 

Third-Party Websites 

Our websites and online services may include links to third-party websites, plug-ins and applications. Except where we post, link to or expressly adopt or refer to this Privacy Policy, this Privacy Policy does not apply to, and we are not responsible for, any personal information practices of third-party websites and online services or the practices of other third parties. Updates to This Privacy Policy 

We will update this Privacy Policy from time to time. When we make changes to this Privacy Policy, we will change the “Last Updated” date at the beginning of this Privacy Policy. If we make material changes to this Privacy Policy, we will notify you by email to your registered email address, by prominent posting on this website or our online services, or through other appropriate communication channels. All changes shall be effective from the date of publication unless otherwise provided.

ADDITIONAL CALIFORNIA PRIVACY DISCLOSURES 

Scope of Disclosures 

These Additional California Privacy Disclosures (the “CA Disclosures”) supplement the information contained in our Privacy Policy and apply solely to individual residents of the State of California (“consumers” or “you”).  

These CA Disclosures provide additional information about how we collect, use, disclose and otherwise process personal information of individual residents of the State of California, either online or offline, within the scope of the California Consumer Privacy Act of 2018 (“CCPA”).   

Unless otherwise expressly stated, all terms in these CA Disclosures have the same meaning as defined in our Privacy Policy or as otherwise defined in the CCPA.   

Personal Information Disclosures 

When we use the term “personal information” in these CA Disclosures, we mean information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household.  

For the purposes of these CA Disclosures, personal information does not include:  

  • Publicly available information from government records. 
  • Deidentified, aggregated or anonymized information that is maintained in a form that is not capable of being associated with or linked to you. 
  • Information excluded from the CCPA’s scope, such as:  
  • Health or medical information covered by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the California Confidentiality of Medical Information Act (CMIA) or clinical trial data; 
  • Information covered by certain sector-specific privacy laws, including the Fair Credit Reporting Act (FRCA), the Gramm-Leach-Bliley Act (GLBA) or California Financial Information Privacy Act (FIPA), and the Driver’s Privacy Protection Act of 1994.  
  • Information relating to our job applicants, employees, contractors and other personnel, which is not governed by these Disclosures.  

Collection and Use of Personal Information 

We collect various categories of Personal Information in connection with our services. Please review the Our Collection of Personal Information section of the Privacy Policy to learn more about the personal information we collect. 

In the last 12 months, we have collected the following categories of personal information from the following sources of personal information.

Inferences, including information generated from your use of the websites reflecting predictions about your interests and preferences.

For example, to allow you to place an order in-store or online, have it delivered to you, or to provide you with the information that you request. In addition, if you share your name and contact information to ask a question about our products or services, we will use that personal information to respond to your inquiry.  
  • To fulfill your transactions or purchases (e.g., to process credit card payments in connection with your transaction). 
  • To communicate with you, including to send you service-related emails or messages and communications from or about Viridis Technologies and to send you important information regarding the services, such as certain changes to our terms, conditions, policies, and/or other administrative information. 
  • To process your registration on our services, including verifying your information to ensure its accuracy and validity. 
  • To operate, maintain, and provide to you the features and functionality of the service.  
  • To market to you, including through email or direct mail, and to inform you of products, programs, services, and promotions that we believe may be of interest to you, including, without limitation, adding you to our email/mailing lists and permitting you to participate in sweepstakes, contests, and similar promotions (collectively, “Promotions”).

Disclosure of Personal Information 

As described in our Privacy Policy, we share personal information with a variety of third parties for business purposes or we may sell your personal information to third parties, subject to your right to opt out of those sales (see The Right to Opt-Out of Personal Information Sales below).  

We disclose personal information to the following categories of third parties:  

  • Within Viridis Technologies.  We may share your personal information with other companies owned or controlled by Viridis Technologies, and other companies owned by or under common ownership as Viridis Technologies, which also includes our subsidiaries (i.e., any organization we own or control) or our ultimate holding company (i.e., any organization that owns or controls us) and any subsidiaries it owns;  
  • Our Franchisees:  We may share information with our franchisees, particularly when we collaborate in providing the services to you.   
  • Service providers. We engage a number of third-party service providers that perform business or operational services for us or on our behalf and as needed to provide the services, such as website hosting, infrastructure provisioning, IT services, customer service, email delivery services, marketing and advertising services, and other similar services, subject to contractual terms restricting the collection, use and disclosure of your personal information for any other commercial purpose.   
  • Promotional partners. We may disclose personal information to third parties with whom we partner to provide contests, surveys, joint promotional activities or co-branded or co-sponsored services, and such disclosure is necessary to fulfill your request or application. 
  • Ad networks and advertising partners. We work with third-party Ad Networks and Advertising Partners to deliver advertising and personalized content to you on our service, on other sites and services you may use, and across other devices you may use. These parties may collect information directly from your browser or device when you visit the services through cookies or other tracking technologies. This information is used to provide and inform targeted advertising, as well as to provide advertising-related services such as reporting, attribution, analytics and market research. 
  • Analytics providers. We work with third-party analytics providers to better understand the demographics of our users and visitors, and to personalize, enhance and improve our services. 
  • Social networks. We may disclose personal information, such as a unique identifier, hashed email address, or information automatically collected through tracking technologies, to social networks for the purpose of displaying personalized advertising and content on those social networks. 
  • Third parties at your request. We share your personal information with third parties with your consent or at your direction.   
  • Law enforcement and third parties pursuant to legal request. From time to time, we may disclose personal information as reasonably necessary to respond to law enforcement requests and as required by applicable law, court order, or governmental regulations. 
  • Third parties in the context of a corporate transaction. We may disclose personal information as reasonably necessary to evaluate, negotiate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Viridis Technologies’ assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by Viridis Technologies about consumers is among the assets transferred or is otherwise relevant to the evaluation, negotiation or conduct of the transaction. 

In the previous 12 months, we have disclosed all of the categories of personal information we collect, explained in the table above, to third parties for a business purpose. 

In the previous 12 months, we have not sold personal information as most people would typically understand that term. However, we do allow certain advertising networks, social media companies and other third-party businesses to collect and disclose your personal information directly from your browser or device through cookies and related technologies when you visit or interact with our websites or otherwise engage with us online. Please see the Third-Party Tracking and Online Advertising section below for more information about how third parties use cookies and related technologies to collect information automatically on our websites and other online services, and the choices you may have in relation to those practices. 

Your California Privacy Rights 

As a California resident, you may be able to exercise the following rights in relation to the Personal Information about you that we have collected (subject to certain limitations at law):  

The Right to Know  You have the right to request any or all of the following information relating to the personal information we have collected about you or disclosed in the last 12 months, upon verification of your identity: The specific pieces of personal information we have collected about you; The categories of personal information we have collected about you; The categories of sources of the personal information we have collected about you; The categories of personal information that we have disclosed about you to third parties for a business purpose, and the categories of recipients to whom this information was disclosed; The categories of personal information we have sold about you (if any), and the categories of third parties to whom this information was sold; and The business or commercial purposes for collecting or, if applicable, selling personal information about you. 
The Right to Request Deletion  You have the right to request the deletion of personal information that we have collected from you, subject to certain exceptions. 
The Right to Opt Out
 of Personal Information Sales 
You have the right to direct us not to sell personal information we have collected about you to third parties now or in the future.  If you are under the age of 16, you have the right to opt in, or to have a parent or guardian opt in on your behalf, to such sales.  
The Right to Non-Discrimination  You have the right not to receive discriminatory treatment for exercising any of the rights described above.  However, please note that if the exercise of the rights described above limits our ability to process personal information (such as in the case of a deletion request), we may no longer be able to provide you our products or services or engage with you in the same manner.

How to Exercise Your California Privacy Rights  

To Exercise Your Right to Know or Right to Deletion 

We will need to verify your identity before processing your request, which may require us to request additional personal information from you or require you to log into your account.  We will only use personal information provided in connection with a Consumer Rights Request to review and comply with the request.  

In certain circumstances, we may decline a request to exercise the right to know and/or right to deletion, particularly where we are unable to verify your identity.    

To Exercise Your Right to Opt Out of Personal Information Sales 

Unless you have exercised your Right to Opt Out of Personal Information Sales, we may sell personal information to third parties for monetary or other valuable consideration. The third parties to whom we may sell personal information may use such information for their own purposes in accordance with their own privacy statements, which may include reselling this information to additional third parties.  

As noted above, we do not sell personal information as most people think of that term. You may, however, exercise your right to opt out of any future potential sales by clicking the link below and following the instructions:  

You do not need to create an account with us to exercise your Right to Opt Out of Personal Information Sales. However, we may ask you to provide additional personal information so that we can properly identify you in our dataset and to track compliance with your opt out request. We will only use personal information provided in an opt out request to review and comply with the request. If you chose not to provide this information, we may only be able to process your request to the extent we are able to identify you in our data systems.

Third-Party Tracking and Online Advertising 

We utilize third-party partners to engage in online advertising. These ad networks, social media companies and other third-party businesses collect your personal information directly from your browser or device through cookies or similar tracking technology when you visit or interact with our websites, use our apps or otherwise engage with us online. For example, they may collect Internet/Network information, such as a cookie or device ID, browsing history and website usage, Geolocation Data, and Inferences generated from your browsing history and interactions with our service as well as other sites and services.  These third-party businesses use your personal information to serve relevant ads on our site, on other websites or mobile apps, or on other devices you may use, or to personalize content and perform other advertising-related services such as reporting, attribution, analytics and market research. These third parties may use such personal information for their own purposes in accordance with their own privacy statements, which may include reselling this information to additional third parties, including other advertising networks.

Minors Under Age 16.   

We do not sell the personal information of consumers we know to be less than 16 years of age, unless we receive affirmative authorization (the “Right to Opt In”) from either the minor who is between 13 and 16 years of age, or the parent or guardian of a minor less than 13 years of age. California’s ”Shine the Light” Law 

At the time of this writing, we do not provide your personal information to third parties for their direct marketing purposes, as described in California’s “Shine the Light” law (Civil Code Section §1798.83). Please note that to opt-out of all disclosures to third parties for direct marketing purposes, you must provide your personal information to be added to our suppression list. 

Authorized Agent 

In certain circumstances, you are permitted to use an authorized agent to submit requests on your behalf where (i) you provide sufficient evidence to show that the requestor is an authorized agent with written permission to act on your behalf and (ii) you successfully verify your own identity with us.  

Updates to These CA Disclosures 

We will update these CA Disclosures from time to time. When we make changes to these CA Disclosures, we will change the “Last Updated” date at the beginning of these CA Disclosures.  All changes shall be effective from the date of publication unless otherwise provided in the notification.
